29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) Wyvern Site, Track Location OOC 418.1 - On or about January 24, 2017, the employer exposed employees to an engulfment hazard, in that employees working in an unprotected trench, ranging from 6 to 9 feet deep with walls that had been cut almost vertically, were not provided with retaining devices to prevent soil from falling into the excavation. The spoil pile was placed at the edge of the north wall.
