29 CFR 1910.95(g)(5)(i): The employer did not establish, within 6 months of an employee's first exposure at or above the action level, a valid baseline audiogram against which subsequent audiograms could be compared: A baseline audiogram was not established for employees with the following exposures: NOTE: The action level of 85 dBA was adjusted based on the 12 hour work period to 82.1 dBA a) 9000 River Rd, Delair, NJ, 08110- Building 11 Shipping Department : A saw operator was exposed to continuous noise levels in excess of the allowable 8-hour time-weighted average sound level (Action Level). The employee's dosimeter dBA level was 88 % of the permissible level (82.1 dBA) and was equivalent to approximately 89.1 dBA. The sampling was performed for 643 minutes during one shift on 2/23/2017. Zero exposure was assumed for the unsampled period of time. b) 9000 River Rd, Delair, NJ, 08110- Extrusion department: A saw operator was exposed to continuous noise levels in excess of the allowable 8-hour time-weighted average sound level (Permissible Exposure Limit). The employee's dosimeter dBA level was 188.7% of the permissible level (90 dBA) and was equivalent to approximately 94.6 dBA. The sampling was performed for 597 minutes during one shift on 2/23/2017. Zero exposure was assumed for the unsampled period of time. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
