29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold more than 10 feet (3.1m) above a lower level, not otherwise specified in paragraphs (g)(1)(I) through (g)(1)(vi) of this section, was not protected from falling to that lower level by use of personal fall arrest systems or guardrail systems meeting the requirement of paragraph (g)(4) of this section: IN THE ALTERNATIVE: 29 CFR 1926.451(g)(2): Effective September 2, 1997, the employer did not have a competent person determine the feasibility and safety of providing fall protection for employees erecting or dismantling a scaffold. Employers are required to provide fall protection for employees erecting dismantling supported scaffolds where the installation and use of such protection is feasible and does not create a greater hazard. Location: 325 Kent Avenue, Brooklyn, NY. 4th Floor Courtyard North Side of South Tower. a) Employee was working or altering the Dunlop 12000 mast climber scaffold and was not utilizing a complete fall protection system. The employee fell two stories to the courtyard. On or about 12/09/2016.
