Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to the hazards of falling down the shaftway when the freight platform was not in the landing zone, being struck by the freight platform when the platform was entering or leaving the platform zone, or having part of their body caught between the moving freight platform and the shaftway. Establishment - Basement through Fifth Floor:The hoistway gates were not electrically/mechanically interlocked to prevent the gates from being opened when the freight platform was not at the landing. A feasible and useful method to correct this hazard, among other methods, is to provide hoistway gates that are electrically/mechanically interlocked to prevent employees from having any part of their body within the hoistway, outside the periphery of the landing, unless the freight platform is within the landing zone.ng
