29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. a. On or about May 12, 2016 and at times prior, employees were operating a Hyster battery powered forklift, Model E120XL, Serial CO98D02616T, at the facility. The forklift had a damaged hydraulic hose, rear lights, and backup alarm, exposing employees to a crushed by hazard.
