29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. a) On or about 5/6/2016, Mixer Area: A front platform on the mixer had chain guardrails that had six inches of deflection. The top rails were a height of 28 inches and the midrails were at a height of 12 inches. Employees exposed to falls of 10.5 feet. b) On or about 5/6/2016, Mixer Area: A front platform on the mixer was not provided with any midrail. Employees exposed to falls of eight feet. c) On or about 5/6/2016, Mixer Area: A platform on the second level of the mixer had an unguarded platform opening. Employees exposed to falls of eight feet. d) On or about 5/6/2016, Mixer Area: A platform on the second level of the mixer, in the front was not provided with a rail system. Employees were exposed to falls of eight feet. e) On or about 5/6/2016, Inside Form Area: No rails or other fall protection was provided while employees were walking and working on top of forms. Employees exposed to falls of 6.5 feet. f) On or about 6/7/2016, Exterior Form Area: No rails or other fall protection was provided while employees were walking and working on top of the forms. Employees exposed to falls of nine feet. g) On or about 6/7/2016, Platform Above the Turret: The top rails were at a height of 27 inches above the platform and the midrails were at a height of 8 inches above the platform. Employees exposed to falls of 34 feet. h) On or about 6/7/2016, Sand/ Aggregate Bins: No rails or other fall protection was provided while employees were walking and working on top of the bins. Employees exposed to falls of 8 feet. Abatement certification is required for these items.
