OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to confined space hazards including entanglement, combustible dust, engulfment, and atmospheric hazards: (a) Dinklage Feed Yard Inc, at 13946 Morgan County Road 21, Fort Morgan, CO: On and preceding 12/22/15, the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to confined spaces hazards. Employees entered the corn bin to perform end of season cleaning of residual corn. The employees entered the small leg boot pit and big leg boot pit to clean the pits. The employees entered the truck scale pit to clean the pit. The corn bin, well #2 pit, small leg boot pit, big leg boot pit, and truck scale were determined by the employer to be confined spaces and to contain multiple hazards, including entanglement hazards, combustible dust hazards, engulfment hazards, and atmospheric hazards. The employer had not addressed emergency procedures, provided emergency retrieval equipment, and provided adequate entry training. This condition exposed employees to confined space hazards.
