Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: S/C the hazard of being struck by a malfunctioning elevator as a result of not conducting regular maintenance of the pressure tanks and piston rods on the water hydraulic elevators. One feasible and acceptable abatement method, among others to correct this hazard is to follow the timely maintenance requirements of ASME A17.1-1965, part X - Rule 1001.2 a) 568 Broadway, Crosby Street side - Elevators #1, 2, 5, and 6 - There was no documentation available to indicate that these components were maintained at least every 3 years prior to the date of the accident.
