29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) Jobsite - The employer does not require employees to use any form of personal fall arrest systems or the use of guardrail systems while performing bricklaying operations from a fabricated frame scaffold. This violation was most recently observed at the property 1401 North Second Street, Philadelphia, PA on or about 19 AUGUST 2014 where employees performing bricklaying operations above the fourth level of the fabricated frame scaffold were not protected from fall hazards of approximately thirty-three (33) feet by the use of personal fall arrest systems or guardrail systems. To abate this ongoing violation, the employer must provide and require the use of personal fall arrest systems or guardrail systems while employees are utilizing the working levels of the scaffold. McGee Plastering and Stucco Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1)(vii), which was contained in OSHA inspection number 314236092, citation number 1, item number 3 and was affirmed as a final order on 27 FEB 2012, with respect to a workplace located at Broad & Catherine Street, Philadelphia, PA 19151.
