29 CFR 1910.252(b)(4)(iv): An attendant with a preplanned rescue procedure was not stationed outside a confined space opening to observe the welder at all times in case of emergency. On or about October 17, 2011, the attendant was allowed to perform other duties and did not observe the welder when he was in the confined space at all times. In the alternative, 29 CFR 1910.146(i)(10): The employer did not ensure that each attendant performed no duties that could interfere with the attendant's primary duty to monitor and protect the authorized entrants: On or about October 17, 2011, the employer allowed the attendants to perform other work duties and as a result no one was continuously monitoring the authorized entrants in the tanks.
