29 CFR 1910.178(q)(7): Powered industrial trucks. Maintenance of industrial trucks. Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a) On or about March 20, 2024, employer did not ensure that the Prime-Mover SN Electric Walkie Straddle Stacker Truck was examined before being placed into service at least daily to ensure that employees were utilizing it without any defects in that the interior electrical attached to the Prime-Mover SN Electric Walkie Straddle Stacker Truck was damaged in that employees are getting shocked when operating the lift in a forward and backward manner every time being use. b) On or about March 20, 2024, employer did not ensure that the Prime-Mover SN Electric Walkie Straddle Stacker Truck was examined before being placed into service at least daily to ensure that employees were utilizing it without any defects in that the interior electrical gang box with knockouts on the sides attached to the Prime-Mover SN Electric Walkie Straddle Stacker Truck it was not installed and used for the gang box intended purpose of being placed inside of walls. c) On or about March 20, 2024, employer did not ensure that the Prime-Mover SN Electric Walkie Straddle Stacker Truck was examined before being placed into service at least daily to ensure that cause of why employees utilizing it were receiving electrical shock in that a damaged flexible cord on the Prime-Mover SN Electric Walkie Straddle Stacker Truck had been spliced and taped. d) On or about March 20, 2024, employer did not ensure that the Prime-Mover SN Electric Walkie Straddle Stacker Truck was examined before being placed into service at least daily in that employees were utilizing it without being aware of the load/weight capacity since the nameplates on the Prime-Mover SN Electric Walkie Straddle Stacker Truck was inside a mechanical compartment and not visible to the operator.
