29 CFR 1926.1101(o)(4)(ii): For Class III and IV asbestos work, the competent person was not trained in aspects of asbestos handling appropriate for the nature of the work, to include procedures for setting up glove bags and mini-enclosures, practices for reducing asbestos exposures, use of wet methods, the contents of this standard, and the identification of asbestos. Location: Worksite On or about November 30, 2023, employees were exposed to asbestos hazards, where the employer did not ensure that a competent person took the 16 Hour Class III asbestos training course, to correctly handle Class III and Class IV asbestos work operations. The operation disturbed intact floor tiles containing 24% chrysotile asbestos and created dust and debris by cutting embedded bolts, hammering the cut bolts into the tiles, and then drilling new floor holes. The Postmaster is in charge of the facility, its asbestos-containing materials documentation, and the Class III and Class IV asbestos work performed at the facility, but has not taken the 16 hour Class III asbestos training course, or any other formal asbestos training that meets or surpasses the requirements of the standard. The employer has previously failed to ensure employees that are performing asbestos operations are properly trained, as seen in previously cited violations as noted below (cited under the alternative OSHA General Industry Standard): a.) The U. S. Postal Service was previously cited for a Repeat-Serious violation of this occupational safety and health standard, or its equivalent standard 29 CFR 1910.1001(j)(7)(iv), which was contained in OSHA inspection number 1637632, citation number 1, item number 1 with an inspection date of 12/7/2022, with respect to a workplace located at 2130 N Kilpatrick St, Portland, OR 97217. b.) The U. S. Postal Service was previously cited for an Other-than-Serious violation of this occupational safety and health standard, or its equivalent standard 29 CFR 1910.1001(j)(7)(iv), which was contained in OSHA inspection number 1537592, citation number 1, item number 2a and was affirmed as a final order on 09/14/2022, with respect to a workplace located at 3775 Industrial Blvd, West Sacramento CA 95799. c.) The U. S. Postal Service was previously cited for a violation of this occupational safety and health standard, or its equivalent standard 29 CFR 1910.1001(j)(7)(iv), which was contained in OSHA inspection number 1567325 citation number 1 item number 1a and was affirmed as a final order on 5/5/2022 with respect to a workplace located at 300 Packerland Drive, Green Bay, Wisconsin, 54303 d.) The U. S. Postal Service was previously cited for a violation of this occupational safety and health standard, or its equivalent standard 29 CFR 1910.1001(j)(7)(iv), which was contained in OSHA inspection number 1369230 citation number 1 item number 2 and was affirmed as a final order on 11/22/2019 with respect to a workplace located at 11600 E. Washington Street, Cumberland, Indiana, 46229.
