29 CFR 1910.134(g)(1)(i)(A): Tight-fitting facepieces shall not be worn by employees who have facial hair that comes between the sealing surface of the facepiece and the face: (a)Dakota Digital Inc. at 4510 West 61st Street North, Sioux Falls, SD 57107: On or about and at times prior to February 9, 2023, the employer did not ensure that employees were protected from respiratory injury or illness in that the employer did not prohibit a tight-fitting facepiece to be worn by employees who had facial hair that comes between the sealing surface of the facepiece and the face. This exposed employees to hazards associated with loose or ill fitting protective respiratory equipment.
