29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. On or about August 18, 2022, and at times prior, at an establishment located at 3555 Moser Street in Oshkosh, Wisconsin; the employer did not ensure that each powered industrial truck was examined before being placed in service or was not removed from service if the examination showed any condition adversely affecting the safety of the vehicle. When defects such as, but not limited to, mismatched fork sizes, unexpected movement from side-to-side while in operation, inoperable horns, and missing control arm panels were found, they were not immediately reported and/or corrected.
