29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition: a) Warehouse Area (Facility - Mobile, AL): On or about April 19, 2021, and times prior, the employer failed to take out of service a Caterpillar Forklift Truck: Model - P5000 and required employees to perform forklift operations with unsafe parts such as but not limited to damaged tires, damaged/missing gas foot pedal and damaged/missing control knobs; exposing employees to struck-by and crushed-by hazards during forklift operations.
