29 CFR 1926.62(d)(2)(v)(B): Until the employer performed an employee exposure assessment as required under 29 CFR 1926.62(d) and determined actual employee exposure, the employer did not provide employees performing the tasks described in 29 CFR 1926.62(d)(2)(i), (d)(2)(ii), (d)(2)(iii), and (d)(2)(iv) with appropriate personal protective clothing and equipment in accordance with 29 CFR 1926.62(g): 1) On or about November 3, 2020, and at prior times, employees sanded lead based paint on a bridge, a task listed in this paragraph (d)(2)(i) of this section. The employer had not determined actual employee exposure, and had not provided appropriate PPE clothing and equipment in accordance with paragraph (g) of this section, including coveralls or similar full-body work clothing, hats, and shoes or disposable shoe coverlets. This exposed workers to potentially elevated blood lead levels, and adverse kidney and central nervous system effects.
