29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: (a) Packing Robot 10/11 - On or about October 25, 2019, the employer did not ensure that employees were protected from fall hazards of approximately nine feet, when accessing the mid section of the racetrack platform to perform sanitation and cleanup. (b) Packing Robot 10/11 - On or about October 25, 2019, the employer did not ensure that employees were protected from fall hazards of approximately nine feet when stepping off the platforms to access the racetrack platform to perform sanitation and cleanup. (c) Packing Robot 10/11 - On or about October 25, 2019, the employer did not ensure that employees were protected from fall hazards of approximately nine feet when reaching through guard rails to retrieve materials such as cardboard boxes and mop heads to perform sanitation and cleanup. On October 25, 2019, an employee suffered an severe occupational injury resulting from a fall when the employee reached across the elevator case through the guardrail to grab a mop head, falling through the elevator case opening approximately nine feet below into the Flexicell Packaging Robot system. In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.
