29 CFR 1910.95(k)(1):The employer did not train each employee who was exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer did not institute a training program and ensure employee participation in the program: The employer did not provide training on noise for the employees with the following exposures: a)Pallet assembly area: A pallet assembler's dosimeter reading was 196.2 % of the permissible exposure limit (90dBa) and was equivalent to approximately 94.9 dBa, The sampling was performed for 393 minutes during one shift on 3/21/24 Zero exposure was assumed for the un-sampled period of time. b)Pallet disassembly area: A dismantler's dosimeter reading was 723.4% of the permissible exposure limit (90dBa) and was equivalent to approximately 104.3dBa. The sampling was performed for 396 minutes during one shift on 3/21/24 Zero exposure was assumed for the un-sampled period of time. c) Pallet assembly area: A pallet assemblers dosimeter reading was 76.7% of the action level (85 dBa) and was equivalent to approximately 88.1 dBa. The sampling was performed for 119 minutes during one shift on 3/21/24 exposure was assumed zero for the un-sampled period of time. The dosimeter was not turned on for the start of the shift, the dosimeter was turned on after employees lunch break. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
