29 CFR 1910.95(g)(1):The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: Location: 130 Old Denville Road. Boonton, NJ 07005 a) The employer did not establish an audiometric testing program in the Post Harvest Trim Room, for employees whose exposures may equal or exceed their appropriate action level. On July 20, 2023, five employees in the Post Harvest Trim Room working near the Kierton Twister T4 Trimming Machine were exposed to noise levels above the 10-hour time-weighted average of 82.1 decibels on the A scale. Employees were exposed to noise levels of 85.3 dba, 87.7 dba, 86.4 dba, and 87.3 dba, respectively. Employees were sampled for 460 minutes, 511, minutes, 521 minutes, 499 minutes, and 508 minutes. Zero exposure is assumed for the unsampled periods of 140 minutes, 89 minutes, 79 minutes, 101 minutes, and 92 minutes. b) The employer did not establish an audiometric testing program in the Post Harvest Trim Room, for employees whose exposures may equal or exceed their appropriate action level. On September 6, 2023, five employees in the Post Harvest Trim Room working near the Mobius M108S Trimming Machine were exposed to noise levels above the 8-hour time-weighted average sound level of 85 decibels on the A scale. Employees were exposed to noise levels of 87.7 dba, 90.6 dba, 87.7 dba, 88.6 dba, and 89.7 dba, respectively. Employees were sampled for 329 minutes, 323 minutes, 328 minutes, 316 minutes, and 328 minutes. Zero exposure is assumed for the unsampled periods of 151 minutes, 157 minutes, 152 minutes, 164 minutes, and 152 minutes. Violation occurred on or around July 20, 2023, and September 6, 2023.
