29 CFR 1910.134(d)(1)(iii): Employees were exposed to respiratory hazards in that the employer did not identify and evaluate the respiratory hazard(s) in the workplace, including a reasonable estimate of employee exposures to respiratory hazard(s) and an identification of the contaminant's chemical state and physical form: Where the employer cannot identify or reasonably estimate the employee exposure, the employer shall consider the atmosphere to be IDLH. (a) Dakota Digital Inc. at 4510 West 61st Street North, Sioux Falls, SD 57107: On or about and at times prior to February 9, 2023, the employer did not ensure that employees were protected from respiratory injury or illness in that no evaluations of respiratory hazards/exposures were completed.
