29 CFR 1910.272(g)(1)(iii): The atmosphere within a bin, silo, or tank in the grain handling facility was not tested for oxygen content prior to employee entry: (a) On or about June 10, 2020, and at times prior to that date for the employee who suffered fatal injuries where possible heat or moisture issues caused in the sunflower seeds to crust to the bin walls in Bin 133 at 2147 77th Avenue SE in Pingree, North Dakota. (b) On or about May 21, 2020 , and at times prior to that date for employees exposed to potential health and safety hazards while entering grain bins to clean out the remaining product at 2147 77th Avenue SE in Pingree, North Dakota.
