29 CFR 1910.1026(g)(2): The employer required respirator use for protection against chromium (VI); however, the employer did not institute a respiratory protection program in accordance with the Respiratory Protection standard, 29 CFR 1910.134, which covers each employee required to use a respirator: a. Rear Yard, Stainless Steel Scrap Burn Area - The employer did not provide an employee with respirator fit-testing and a medical evaluation to determine the employee's fitness to wear his respirator. The employer required this employee to wear respirators such as but not limited to air-purifying 3M Half Facepiece Reusable Respirator 6300/07026 with 3M 2097 P100 filters. An employee, conducting the torch burning of stainless steel scrap, was exposed to 8-hour Time Weighted Average (TWA) of 0.019 milligrams per cubic meter of airborne hexavalent chromium during a 436 minutes occupational exposure. The 8-hour TWA employee exposure was 3.8 times respectively the OSHA Permissible Exposure Limit (PEL) of 0.005 milligrams per cubic meter. The violation was noted on March 7, 2019.
