29 CFR 1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer did not institute a training program and ensure employee participation in the program: a) Production area: On or about August 15, 2018, and at times prior, the employer exposed the grinder operator to noise levels above the action level of 87 decibels (66% dose) without providing training. The employee had an exposure of 93.3 decibels (158.5 % dose) during the 406 minute sampling period. The exposure calculation included a zero increment for the 74 minutes not sampled. b) Production area: On or about August 15, 2018, and at times prior, the employer exposed the baler operator to noise levels above the action level of 87 decibels (66% dose) without providing training. The employee had an exposure of 87.5 decibels (71.03 % dose) during the 404 minute sampling period. The exposure calculation included a zero increment for the 76 minutes not sampled.
