29 CFR 1926.652(a)(1): Each employee in an excavation are not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c) of this section. a) On or about September 16, 2017, and at times prior thereto: the employer did not protect two employees working in an excavation estimated to be 6 feet deep with near vertical walls and within a foot from a two-way road with heavy traffic traveling at 40 mph, from cave-in hazards by properly sloping or using appropriate protective systems. NOTE: Abatement certification and documentation IS required for this item. MDM Construction, Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 459376, citation number 1, item number 1b and was affirmed as final order on March 14, 2013, with respect to a workplace located at 5675 Government Way, Coeur D'Alene, ID 83814.
