29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was required to use the respirator in the workplace. a. On or about July 16, 2013, where the employer provided and required the use of 3M model 8247 filtering facepiece respirators for two employees when removing laundry from two Union P735 U200 dry cleaning machines, the employer did not provide the employees with a medical evaluation to ensure their ability to use the respirators.
