Text For Citation: 01 Item/Group: 002B Hazard:
29 CFR 1910.132(d)(1)(i): The employer does not select, and have each affected employee use, the types of PPE that would protect the affected employee from the hazards identified in the hazard assessment; The employer is failing to protect employees from potential struck by hazards associated with working near farm machinery in corn fields during harvest season. This was most recently evident during the inspection of the Kinbrow Farm located at 816 Road 12, Geneva, NE 68361, where the employer has employees lacking in personal protective equipment working in close proximity to heavy farm machinery resulting in an employee fatality after being ran over by a combine. Instances of necessary personal protective equipment include but are not limited to: i. High visibility or reflective clothing to ensure that employees are not blending into the back ground of the field and are instead highly visible to anyone on the site. ii. Eye protection against flying debris or dust as a result of the employee being exposed to fall harvest time in corn fields where the winds average 15-20mph on a daily basis. iii. Protective foot wear necessary to prevent the employee from having any foreign object penetrate through the sole or lower portion of the foot wear and injure the employee.
