29 CFR 1910.146(c)(4): If the employer decides that its employees will enter permit spaces, the employer shall develop and implement a written permit space program that complies with this section. The written program shall be available for inspection by employees and their authorized representatives. a. On or about June 3, 2011, in the facility, the employer did not develop and implement a permit required confined space program for employee(s) required to enter permit required confined space(s) including production tanks. The employee(s) were exposed to hazards including, but not limited to sweepers and agitators when entering the permit required confined space.
