29 CFR 1910.23 (c)(1) Open-sided floors or platforms 4 feet or more above adjacent floor or ground level were not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. a) Polyester plant tank truck filling platform: Employees filling tankers with chemicals stood on top of the trucks approximately 15 feet above the ground, without fall protection, on or about 10/3/11. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
