North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a)establishment - Yale diesel powered industrial truck did not have a functioning horn or other audible warning system. Among other methods, one feasible and acceptable abatement method to correct this hazard is to inspect industrial trucks prior to operation of the vehicle."
