29 CFR 1926.652(g)(2): Excavations of earth material to a level no greater than 2 feet (.61m) below the bottom of a shield was permitted: a) On or about April 24, 2025, at the Foxdale Ave. Water Main Project in Winnetka, Illinois, employees were permitted to enter an excavation and perform work where the earth material was excavated approximately four feet below the bottom of the support system, Build-A-Box BAB-4 Modular Trench Shield. b) On or about May 1, 2025, at the Foxdale Ave. Water Main Project in Winnetka, Illinois, employees were permitted to enter an excavation and perform work where the earth material was excavated approximately three feet and nine inches below the bottom of the support system, Pro-Tec Trench Shield, Serial #35715. c) On May 2, 2025, the Foxdale Ave. Water Main Project in Winnetka, Illinois, employees were permitted to enter an excavation and perform work where the earth material was excavated approximately seven feet six inches on the north wall, four feet six inches on the east wall, and six feet five inches on the south wall, below the bottom of the support system, Build-A-Box BAB-4 Modular Trench Shield. d) On May 2, 2025, the Foxdale Ave. Water Main Project in Winnetka, Illinois, employees were permitted to enter an excavation and perform work where the earth material was excavated approximately four feet six below the bottom of the support system, the Build-A-Box BAB-6 Modular Trench Shield. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
