29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: ASB Sports Acquisitions doing business as Game One located at 11500 Tailwinds Drive in Swanton, Ohio; On or about October 17, 2024 the employer did not ensure employees who were required to wear filtering facepiece respirators or employees voluntarily choosing to wear half face elastomeric respirators were provided with a medical evaluation to determine the employees' ability to wear a tight-fitting respirator. Employees were exposed to hazards associated with wearing a tightfitting respirator such as, but not limited to, aggravation of pulmonary issues, such as asthma, emphysema, and aggravate claustrophobia, all contributing to negative health effects.
