29 CFR 1910.178(l)(1)(i):The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). On or about September 25, 2024, the employer did not ensure employees and foremen operating high lift order picker type powered industrial trucks were competent to operate the high lift order picker trucks safely by successfully completing training and an evaluation.
