1926.21(b)(2) The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) On or about August 2, 2024, at a worksite located at 10300 Baltimore Ave. Beltsville, MD, employees were exposed to struck by hazards while standing on an unscecured, unbalanced load. The employees were unloading shoring panels with a Caterpillar 926 front end loader and were not trained in the recognition and avoidance of unsafe conditions. b) On or about August 2, 2024, at a worksite at 10300 Baltimore Ave. Beltsville, MD, employees were exposed to struck by hazards while working around a Caterpillar 926 front end loader. The operator was in the process of off-loading shoring panels, with employees standing on the panels, which were unsecured and unbalanced. The operator was not trained to recognize the hazards and unsafe conditions associated with the equipment and the operation. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet). In addition, documentation demonstrating that the abatement is complete must be included with your certification. This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
