29 CFR 1926.1427(f)(1)(i): Through an evaluation, the employer did not ensure that each operator was qualified by a demonstration of the skills and knowledge, as well as the ability to recognize and avert risk, necessary to operate the equipment safely, including those specific to the safety devices, operational aids, software, and the size and configuration of the equipment. Size and configuration includes, but is not limited to, lifting capacity, boom length, attachments, luffing jib, and counterweight set-up. a) On or about January 12, 2024, at a worksite located at 6121 Pennington Avenue, Baltimore, MD, the employer did not ensure that employees operating an 895 Liebherr Crane, were evaluated on all operations of the crane including unspooling the stabilization winch which exposed employees to being caught by and/or struck by the moving wire rope while the diesel engine was still on. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
