29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) Super Stone Global Inc. located at 87 14th Street, Brooklyn, NY 11215 Employees working in the warehouse, performing the manufacturing of stone products are exposed to the hazard of chemicals. Employees are required to wear 3M N95 8210 series particulate respirators while handling chemicals such as but not limited to respirable crystalline silica when fabricating stone products however, the employer did not provide medical evaluations by a physician or licensed health care professional (PLHCP) to qualify employees to wear respirators. Condition observed on or about December 21, 2023 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19
