29 CFR 1910.29(b)(1): The employer did not ensure that guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, that are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section: (a)TM Industries, LLC at 24211 412th Avenue, Artesian, SD 57314: On or about and at times prior to December 13, 2023, the employer did not ensure a top rail was installed to the guardrail system that was at least 42 inches from the working surface on the mezzanine or second level area in that only one guardrail measuring 30 inches was installed. This condition exposed employees to a fall hazard of eight feet.
