29 CFR 1926.959(d)(3)(ii): The mechanical equipment was not positioned so that its uninsulated portions could not approach the energized lines or equipment any closer than the minimum approach distances established by the employer: a) On or about August 9, 2023, an excavator operated by Harper Brothers Construction, LLC, the general contractor, was positioned where the uninsulated boom could approach an energized overhead power line closer than the minimum approach distance, exposing R&A Boring LLC employees to electrocution hazards.
