29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a) Bucks County Shutters - Paint Area - On or about June 2, 2023, painters were exposed to hazardous chemicals, such as but not limited to, Sherwin Williams ProClassic Satin Enamel and Sherwin Williams Lacquer Thinner, and the employer did not provide effective information and training on hazards of such chemicals as required. Bucks County Shutters was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1200(h)(1), which was contained in OSHA inspection number 1561570, citation number 1, item number 3c and was affirmed as a final order on May 6, 2022, with respect to a workplace located at 940 Thomas Dr., Warrington, PA. Bucks County Shutters was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1200(h)(1) as "Repeat", which was contained in OSHA inspection number 1629275, citation number 1, item number 2b and was affirmed as a final order on March 10, 2023, with respect to a workplace located at 940 Thomas Dr., Warrington, PA. ABATEMENT NOTE: Employees shall be informed of the following: 1. The requirements of this section; 2. Any operations where hazardous chemicals are present; 3. The location and availability of the written Hazard Communication Program, list(s) of hazardous chemicals and Safety Data Sheets. Employee training shall include at least: 1. Methods and observations that may be used to detect the presence or release of hazardous chemical in the work area. 2. The physical, health, simple asphyxiation, combustible dust, and pyrophoric gas hazards, as well as hazards not otherwise classified, of the chemicals in the work area. 3. The measures employees can take to protect themselves such as specific procedures and personal, protective equipment to be used. 4. The details of the employer's Hazard Communication Program including an explanation of the labels received on shipped containers and the workplace labeling system used by the employer; Safety Data Sheets, including the order of information and how employees can obtain and use the appropriate hazard information. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.
