29 CFR 1910.178(l)(3)(ii)(I): Training program content. Powered industrial truck operators shall receive initial training in the following topics, except in topics which the employer can demonstrate are not applicable to safe operation of the truck in the employer's workplace. Other unique or potentially hazardous environmental conditions in the workplace that could affect safe operation. a) On or about April 23, 2023, The Kroger's Cincinnati Fresh Center did not adequately train powered industrial vehicle operators operating equipment such as but not limited too; forklifts, ride in and ride behind (walkies) equipment on the unique environmental hazard created through their "pay per minute" incentive program that affected safe operations of the powered industrial vehicles. Employees performing picking operations would earn pay incentives for picking over 100% during a shift. Powered industrial vehicle operators in the perishable and freezer areas were observed on video operating the powered industrial vehicles in unsafe manners, including exiting PIVs before the PIVs stopped to pick, unsafe traffic patterns, including running between other powered industrial vehicles where employees were dismounted to perform picking or loading operations.
