29 CFR 1910.120(q)(3)(ii): Procedures for Handling Emergency Response. The individual in charge of the ICS shall identify, to the extent possible, all hazardous substances or conditions present and shall address as appropriate site analysis, use of engineering controls, maximum exposure limits, hazardous substance handling procedures, and use of any new technologies. a) On or about March 23, 2023 at Depallitizer #1, the employer in charge of the incident command system (ICS) did not identify the hazardous substances present for the frequent spills that were being caused by the Depallitizers. Furthermore, the employer neglected to conduct a site analysis, establish maximum exposure limits, and implement appropriate procedures for the handling hazardous substances. As a result, Sanitation Workers, during an emergency response to a chemical spill were exposed to hazardous chemicals which include but are not limited to Clorox Bleach (sodium hypochlorite 4.5%) and The Works Toilet Boil Cleaner (hydrochloric acid 5-10%) with the potential for the creation of chlorine gas when these two substances were mixed.
