29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: a) Lowe's retail store, 265 McLean Blvd., Paterson, NJ: On or about March 14, 2023, an employee used gas-powered saws to cut concrete, while another employee assisted by spraying water on the saw cuts to control dust. The employer required employees to wear P95 filtering facepiece respirators, but did not identify and evaluate the employees' exposure to respiratory hazards.
