29 CFR 1926.1053(b)(16):Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired. The employer failed to mark or tag a damaged ladder on the job site in a manner that identified it as being defective and withdraw it from use. This was most recently documented on or about May 23, 2022 at a residential construction jobsite located at 4513 S 215 Ave, Elkhorn Nebraska. The employer did not ensure that a damaged aluminum extension ladder being used by employees as means of access and egress to the upper working areas was withdrawn from service.
