29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace: Maintenance barn: On or about April 19, 2022, and at times prior thereto, employees were exposed to an undue physiological burden when applying chemicals such as, but not limited to, Ruckus Liquid fertilizer, Quali-Pro MSM Turf Herbicide, and are required to wear respirators without a medical evaluation.
