29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavation(s), or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) On or about October 22, 2021, at the job site located on the Southwest side corner of W. Ryan Rd & W. Loomis Rd. Franklin, WI, an employee working in an excavation approximately twenty-two (22) foot deep conducting horizontal boring under a roadway for placement of a water line utility, were exposed to struck by hazards from falling rocks and dirt from above that were not contained, or otherwise barricaded, and, or separated by at least 2 feet from the edge of the trench.
