29 CFR 1926.651(k)(2):Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a)Lidel Construction Company, Inc. at East 69th Street North & North Seubert Avenue, Sioux Falls, SD 57104: On or about and at times prior to September 14, 2021, the employer did not ensure that an employee was removed from hazardous area within a vertical walled, unprotected trench excavation. An employee was working within the unprotected excavation that was approximately 7 feet 10 inches in depth with no protective system. This condition exposed the an employee to a cave-in hazard associated with trench wall failure.
