29 CFR 1910.28(b)(6)(i):29 CFR 1910.28(b)(6)(i): The employer did not ensure that each employee less than 4 feet (1.2 m) above dangerous equipment is protected from falling into or onto the dangerous equipment by a guardrail system or a travel restraint system, unless the equipment is covered or guarded to eliminate the hazard. On or about March 9, 2021, the employer failed to protect employees from a fall into dangerous equipment. Employees were working from a platform on the FIS Line 1, that had the top rail removed and below them was a mechanized auger that was unguarded. Employees leaned over mid rail to reach across the auger below to pull pieces of material off the fixed grate. Employees exposed to falling into the unguarded rotating auger shaft. On or about March 9, 2021, the employer failed to protect employees from a fall into dangerous equipment. Employees were working from a platform on the FIS Line 2, and below them was a mechanized auger that was unguarded. Employees are reaching over the top rail and in-between the top and mid rail opening in order to reach across the auger below to pull pieces of material off the above fixed grate. Employees exposed to falling into the unguarded rotating auger shaft.
