29 CFR 1910.1053(d)(3)(i):The employer did not perform initial monitoring to assess the 8-hour TWA exposure for each employee on the basis of one or more personal breathing zone air samples that reflect the exposures of employees on each shift, for each job classification, in each work area. a) On or about December 02, 2020, throughout the facility, employees (Forklift Operator/Laborer) were exposed to Crystalline Silica above the PEL in concentration of 149 mcg/m3, filling bags of gravel/sand/pebbles aggregate and stacking bags on a pallet without wearing appropriate Personal Protective Equipment (Respirators) throughout the duration of the day. b) On or about December 02, 2020, at the Aggregate Filler machine, employees (Laborer) were exposed to airborne Crystalline Silica in concentrations of 176.3mcg/m3 while filling bags of gravel/sand/pebbles and stacking bags on a pallet. c) On or about December 02, 2020, at the Aggregate Filler machine, employees (QC/Laborer) were exposed to airborne Crystalline Silica in concentrations of 75.2mcg/m3 while filling bags of gravel/sand/pebbles and stacking bags on a pallet.
