Text For Citation: 01 Item/Group: 002B Hazard:
29 CFR 1926.201(a): Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers, shall conform to Part 6 of the MUTCD (incorporated by reference, see �1926.6) a) On or about March 12, 2020 and prior to that time located on OH-28 between Maple Grove Rd and US-50 Chillicothe OH 45601 for a short duration or mobile utility construction work crew in which the employer opted to utilize temporary traffic control work zone flagger stations and signaling by flaggers on a two lane rural 45 mph roadway the employer did not conform to 2009 MUTCD Standard Part 6E.08.01, Table 6E-1, in that, the employer established flagger station(s) and flagger(s) were not positioned at a stopping sight distance as a function of speed sufficiently in advance of company work vehicles, or equipment due to the location of flagger station(s) and flagger(s) being within in the activity areas longitudinal work or buffer space 10 to 150 feet from company work vehicles, or equipment while the 2009 MUTCD Table 6E-1 stopping sight distance as a function of speed for the posted speed limit of 45 mph was 360 feet exposing flagger(s) and workers in the work space to the hazard of being struck by road user traffic without a sufficient distance to stop at an intended stopping point. b) On or about March 12, 2020 and prior to that time located on OH-28 between Maple Grove Rd and US-50 Chillicothe OH 45601 for a short duration or mobile utility construction work crew in which the employer opted to utilize temporary traffic control work zone flagger stations and signaling by flaggers on a two lane rural 45 mph roadway the employer did not conform to 2009 MUTCD Standard Part 6E.08.01, in that, the employer established flagger station(s) and flagger(s) were not positioned at a stopping sight distance as a function of speed sufficiently in advance of company work vehicles and workers in the work space that approaching road users would have sufficient distance to stop at an intended stopping point ahead of workers in the work space without an established procedure by the employer for the flagger to utilize to warn company work space workers with audible warning devices such as horns or whistles of approaching danger by out-of-control errant vehicles exposing company stationary work space workers to the potential of being struck by an errant vehicle 2009 MUTCD Standard Part 6E.08.01: Flagger Stations: Flagger stations shall be located such that approaching road users will have sufficient distance to stop at an intended stopping point.
