29 CFR 1910.29(b)(1): 29 CFR 1910.29(b)(1): A top rail, or equivalent guardrail system member, 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface was not installed: At a worksite located at 111 W Fountain Rd., Webb City, MO: Employees were exposed to fall hazards. The employer is failing to ensure that employee are protected from falling while working on surfaces that were elevated over 4 feet. This was demonstrated on February 12, 2020 when an employee was permitted to use the ladder to reach a platform located in the grinding area with an unprotected sides or edges. This platform is located approximately 8 feet above the concrete floor and contains short railings that only come to the employees waist (38 inches). In addition, on the ladder side of the platform there is nothing in place to prevent a worker from falling backwards while they are checking the magnet.
