29 CFR 1926.62(d)(2)(ii): When the employer had any reason to believe that employee(s) had been exposed to lead in excess of the Permissible Exposure Limit (PEL) while performing a task not listed in 29 CFR 1926.62(d)(2)(i), until the employer performed an employee exposure assessment as required by 29 CFR 1926.62(d) and documented that the employee's lead exposure was not above the PEL, the employer did not treat the employee as if the employee was exposed above the PEL and did not implement employee protective measures as prescribed in 29 CFR 19126.62(d)(2)(v): The employer is failing to prevent employee exposure to lead hazards. The condition was most recently documented on February 28th, 2019, at 137 Hale Library, Manhattan KS. Employees engaged in paint removal activities in rooms 212 and 117 were exposed to lead hazards in that the employer did not treat employees as if they were exposed above the PEL in failing to perform an employee exposure assessment.
